OUR APPEAL WAS ON MONDAY 1ST JUNE 2009 AT 11:45AM IN WEST LOTHIAN OUR DAUGHTER DID NOT GET INTO OUR FIRST AND ONLY CHOICE OF CATHOLIC SCHOOL ALTHOUGH WE ARE CATHOLIC BUT OUR DAUGHTER WAS NOT BAPTISED.
WE GOT OUR DAUGHTER BAPTISED ON THE SUNDAY 31ST MAY 2009 THE NEXT DAY WE WENT TO THE APPEAL FEELING SICK WHEN WE GOT TO THE BUILDING AND WENT IN WE WERE TAKEN INTO A OFFICE AND TOLD THAT THE HEAD MASTER OF OUR CHOICE SCHOOL HAD LOOKED AT THE TIME TABLES OVER THE WEEKEND AND IN TURN HAD FOUND TWENTY OTHER PLACES AND OUR DAUGHTER WAS IN WITHOUT A DOUBT.
WAS THIS BECAUSE WE KEPT ASKING THE COUNCIL LOADS OF QUESTIONS AS WELL AS OUR SOLICITOR HAD SENT THEM A LETTER FROM HIMSELF AS WELL AS THE INFORMATION FROM AN ADIVCATE STATING WHY OU DAUGHTER HAD THE WRITE TO GET IN TO THIS SCHOOL AND ALSO THE CRITERA WAS NOT LISTED PROPERLY.
EVEN THE SECERTARY SAID THIS WAS A STRANGE ONE AND THIS HAS NEVER HAPPENED IN ALL THE YEARS SHE HAS DONE THE JOB.
WE FIND IT VERY STRANGE BUT WE ARE SO HAPPY SHE GOT IN.

It would appear that there was an adminstrative error, so you automatically receive a place if you can prove this.

I wish the school we are appealing to would find 20 extra places It does seem strange though doesn't it how would they happen, perhaps the head kept the places back so that everybody would dash off and get baptised who knows?? anyway she is in so thats great news well done

i do not know if it was to do with the baptisem but she had started the course las september and finished it in the nov/ december but my sister has a terminal illness so we thought we would baptise her later. we also asked the council loads of question in connection with section 28a11 and so forth we did not let it lie perhaps they knew we would not let it go ( i was willing to go to the court of session if need be)
Our solicitor said that when this happens it usally means someone had made a monumental error if you know what i mean. but if there is anyone in scotland who needs a solicitor that deals with school appelas then i am only to happy to direct you in that direction as it is very ahrd to get one in scotland although it is easyer to get solicitors in england that deal with school appeals
another thing is if your child is 12 yrs and over you can get legal aid as they are termed as old enough to instruct a solicitor our daughter was a month to young though but it isa thought as it is quite expensive
good luck to everyone who goes to appeal don't let them get you our your child down i know how stressfull it can be but just think it is worth the fight
